Behind each topic you find the legal position, the process and answers to the most common questions.
- Gambling losses 1 licence Online casinos without an Austrian licence must repay losses. We enforce that.
- Loan fees up to 4% Processing fees your bank charged without a valid basis: the firm reclaims them for you in a bundle.
- Rent Index clause If your rent climbs with the index, the clause is often void. We check that.

Attorney Dr. Oliver Peschel
- Founder of the platform
- Casino claims since 2019
- University lecturer
Many know him from ZIB 2, alongside coverage in the Kurier and the Financial Times. Dr. Oliver Peschel founded DeineRechte.at and has been recovering online casino losses since 2019, as one of the first lawyers in Austria to do so.
He wrote his doctorate on European civil procedure law and runs the law firm Peschel & Partner Rechtsanwälte at Karmeliterplatz in Vienna together with attorney Mag. Manuel Schölm. That is exactly where your enquiry lands: with lawyers, not in a call centre.

Class action? Strictly speaking: collective proceedings.
Together, not alone.
What everyone calls a class action is legally, in most cases, collective proceedings. The difference: there is no single joint lawsuit for everyone. Every claim is pursued in its own proceedings, against a casino that does not pay out, a bank with inadmissible fees, a landlord with a void clause. What is bundled are the review, the organisation and the enforcement.
That shifts the balance of power. Whoever acts alone negotiates against a corporation, its legal department and its lawyers. In a group, that corporation negotiates against an experienced law firm that knows the same legal issue from many parallel cases.
How DeineRechte.at works
- Step 1
Describe your case
You pick the case group, state the approximate amount and your contact details. It takes a few minutes.
- Step 2
Response from the firm
The team at Peschel & Partner Rechtsanwälte typically gets back to you within two business days with an assessment: is legal action worthwhile, and how will it be funded?
- Step 3
Joint proceedings
If both fit, you join the matching proceedings. From then on the attorneys work for you and keep you posted.
Start free, continue transparently
The initial assessment commits you to nothing. If it comes to proceedings, the attorneys clarify in advance who funds them: your legal expenses insurance, a litigation funder in exchange for a share of the recovery, or you yourself, if you prefer that. The firm handles the correspondence with the insurer and the funder. You only decide about costs once all the numbers are on the table.
What the firm’s clients say
Frequently asked questions about the platform
What is the difference between a class action and collective proceedings?
Colloquially both mean the same thing: many affected people acting together against the same opponent. Legally, the firm runs collective proceedings: every claim remains its own lawsuit, but is reviewed in a bundle with many similar cases and enforced in a coordinated way. It is not one single joint lawsuit for everyone. On this website, class action stands for this approach because it is the more familiar term.
What does participation cost me?
Reviewing your case costs nothing. For proceedings, there are three routes: your legal expenses insurance covers the costs, a litigation funder assumes them in exchange for a share of the recovery, or you fund the proceedings yourself. The firm handles the correspondence with your legal expenses insurance and the litigation funder for you and organises the funding. Without clarified funding, no proceedings are started.
Which cases can I sign up for?
Currently three case groups: losses at online casinos without an Austrian licence, processing fees from loan agreements, and rent increases based on void indexation clauses. Each case group has its own page with details and frequently asked questions.
Who represents me?
The Vienna law firm Peschel & Partner Rechtsanwälte with its two attorneys, Dr. Oliver Peschel and Mag. Manuel Schölm. Dr. Peschel founded the platform and leads the collective proceedings; the firm's team handles your enquiry, and you receive answers from one of the two attorneys.
